1. Acceptance of Terms
By accessing or using MyInstitution ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access the Service.
1.1 Eligibility
You must be at least 18 years old and authorized to represent an educational institution to use this Service. By registering, you warrant that you have the authority to bind your institution to these terms.
1.2 Early-Stage Service
MyInstitution is under active development. Features, pricing, and availability may change as the Service evolves. We will make reasonable efforts to notify registered institutions of material changes.
1.3 Modifications
We reserve the right to modify these terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance.
2. Services Provided
MyInstitution provides educational institution management software including but not limited to:
2.1 Notifications Are Best-Effort
Push notifications are provided free of charge as a convenience feature. We do not guarantee delivery, and institutions should not rely on push notifications as the sole method of communicating time-sensitive or critical information to parents or guardians.
2.2 Planned Features
Additional communication channels, including SMS, may be introduced in the future. Any such feature will be governed by its own pricing and consent terms, communicated separately before activation.
3. Account Registration and Security
3.1 Account Creation
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Security Obligations
You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Types
Accounts are provisioned based on institutional roles (Administrator, Teacher, Parent, Student) with appropriate access levels and permissions.
3.4 Institution as Data Controller
The registering institution is responsible for ensuring it has the lawful right to submit student, parent/guardian, and staff data to the Service, including obtaining any consent required from parents or guardians of minors before entering a student's information. MyInstitution acts only as a data processor, handling data on the institution's instructions.
4. Data Protection and Privacy
4.1 Where Data Is Stored
Data is stored using Supabase and PostgreSQL-based infrastructure. We take reasonable technical measures to protect data, including access controls and encrypted connections, in accordance with our Privacy Policy and applicable Bangladeshi regulations.
4.2 Student Data Protection
We implement appropriate technical and organizational measures to protect student data, including encryption, access controls, and regular security review.
4.3 Data Ownership
Institutions retain ownership of all data submitted to the Service. We only process this data to provide the contracted services.
4.4 Third-Party Infrastructure
While we take reasonable care in selecting infrastructure providers, we are not liable for outages, data loss, or breaches caused by third-party service providers beyond our reasonable control.
5. Communications Services
5.1 Push Notifications
Our push notification service is provided free of charge and is designed for educational communications between institutions and parents/guardians only.
5.2 Prohibited Content
You may not use our communication services to send spam, commercial solicitations, or any content that violates applicable laws or regulations.
6. Payments and Subscription
6.1 Introductory Free Period
New institutions currently receive one (1) month of free access from the date of registration, as a limited-time introductory offer. This offer may be modified, shortened, or discontinued at any time, at our discretion, without prior notice, and does not constitute a guarantee of permanently free access.
6.2 Paid Subscription
After the free period ends, continued use of the Service requires a paid subscription. Pricing and payment methods will be communicated to the institution before any charge is applied.
6.3 No Charge Without Notice
We will not begin charging an institution without first notifying them and providing an opportunity to cancel before the free period ends.
6.4 Billing
All fees are exclusive of taxes. You are responsible for paying all applicable taxes. Subscription fees are non-refundable once a billing period has started.
7. Intellectual Property
7.1 Our Intellectual Property
All rights, title, and interest in the Service, including software, documentation, and trademarks, are owned by MyInstitution or our licensors.
7.2 License Grant
We grant you a limited, non-exclusive, non-transferable license to use the Service for your institutional purposes during your active subscription or free trial period.
8. Termination
8.1 Termination by You
You may terminate your account at any time through your account settings or by contacting our support team.
8.2 Termination by Us
We may suspend or terminate your access to the Service for violation of these terms, non-payment, or legal requirements.
8.3 Data Export
Upon termination, you may export your data for 30 days. After this period, we may delete your data in accordance with our data retention policies.
9. Limitation of Liability
9.1 Service Provided "As Is"
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including uninterrupted availability, error-free operation, or fitness for a particular purpose.
9.2 No Consequential Damages
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or academic records, arising from use of the Service.
9.3 Total Liability
Our total liability for any claims under these terms shall not exceed the total amount paid by you for the Service in the 12 months preceding the claim. During any free trial period, our total liability shall not exceed zero, as no fee was paid during that period.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These terms are governed by the laws of Bangladesh, including applicable provisions of the Information and Communication Technology (ICT) Act, 2006, and the Cyber Security Act, 2023, without regard to conflict of law provisions.
10.2 Dispute Resolution
Any disputes shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be settled in the courts of Pabna, Bangladesh.
